Chek Chek Rider Agreement
Effective Date: 1 October 2026 · Governed by the Laws of the Republic of Ghana
Independent Contractor Rider Agreement
This Agreement ("Agreement") is entered into between Chek Chek Digital Limited ("Platform", "Company", "we", "us"), a company incorporated under the laws of the Republic of Ghana, and the individual identified during the registration process ("Rider", "you", "your"). By completing the registration process and digitally accepting this Agreement, the Rider acknowledges having read, understood, and agreed to be legally bound by all terms and conditions herein. This Agreement establishes an independent contractor relationship and NOT an employment relationship.
⚠️ CRITICAL LEGAL NOTICE — READ CAREFULLY
Operating a motor vehicle without a valid driver's license in Ghana is a criminal offence under the Road Traffic Act, 2004 (Act 683). Riding without valid third-party insurance is a criminal offence under the Motor Vehicle (Third Party Insurance) Act. The Platform has zero tolerance for riders operating without valid documentation. Immediate permanent deactivation and referral to the DVLA/Police Service will result from any breach.

Part I — Eligibility, Licensing & Vehicle Requirements

1.1. Minimum Eligibility Requirements
To be eligible to operate as a Rider on the Chek Chek platform, you must at all times satisfy ALL of the following conditions: (a) be at least 18 years of age; (b) hold a valid Ghana Card (National Identification Card); (c) hold a valid Ghana Driver's License of the appropriate class for your vehicle type issued by the Driver and Vehicle Licensing Authority (DVLA); (d) own or have lawful possession of a roadworthy vehicle registered in Ghana; (e) maintain valid motor insurance at minimum third-party level as mandated by Ghanaian law; (f) have no outstanding criminal convictions related to road traffic offences, violence, theft, or dishonesty within the past 5 years; and (g) be legally authorised to work in the Republic of Ghana.
1.2. Driver's License — Mandatory Requirement
A valid DVLA-issued driver's license is a non-negotiable requirement. The license must: (a) be appropriate for the vehicle class you intend to operate (e.g., Class B for motorcycles, Class C for cars/vans); (b) not be expired, suspended, or revoked; (c) be renewed before expiry — the Platform will send reminders 60 days and 30 days before expiry; and (d) be produced on demand to Platform representatives or law enforcement. Failure to maintain a valid license will result in immediate account suspension pending renewal. Operating after expiry without renewal constitutes grounds for permanent termination.
1.3. Vehicle Registration
Your vehicle must be duly registered with the DVLA. You must submit: (a) a valid Vehicle Registration Certificate; (b) evidence of annual road worthiness certification from a DVLA-approved inspection centre; and (c) notification within 7 days if your vehicle changes. The Platform reserves the right to reject vehicles that are not roadworthy, unsafe, or inappropriate for food delivery.
1.4. Motor Insurance — Legal Obligation
Under the Motor Vehicle (Third Party Insurance) Act (Cap 169), it is a criminal offence to operate a motor vehicle on a public road in Ghana without valid third-party motor insurance. You must: (a) hold valid third-party motor insurance at minimum, with comprehensive cover strongly recommended; (b) ensure your policy covers commercial use / hire and reward where applicable; (c) submit proof of insurance at registration and upon each renewal; and (d) maintain continuous coverage throughout your engagement with the Platform. Your insurance policy must not have lapsed at any time during active operations. Lapsed insurance results in immediate suspension. The Platform expressly disclaims all liability for any incident involving an uninsured rider.
1.5. Road Worthiness Certificate
Your vehicle must pass and maintain a current road worthiness inspection from a DVLA-authorised centre. Road worthiness certificates must be renewed annually. The Platform may, at its discretion, require evidence of mechanical fitness at any time. Vehicles reported as unsafe, emitting excessive smoke, or with visible mechanical defects will be flagged for removal.
1.6. Police Clearance / Good Conduct Certificate
You must provide a current Police Good Conduct Certificate (Criminal Record Check) issued by the Ghana Police Service, not more than 6 months old at the time of application. Individuals with convictions for violent offences, theft, fraud, sexual offences, or serious road traffic offences will not be eligible. The Platform may conduct periodic background checks using available databases.
1.7. Ongoing Document Maintenance
You are solely responsible for maintaining the currency of all required documents throughout your engagement. The Platform's document tracking system will automatically notify you of approaching expiry dates. Failure to renew documents before expiry will trigger automatic account suspension until valid documentation is re-submitted and verified. The Platform accepts no liability for loss of earnings arising from document-related suspensions.

Part II — Independent Contractor Status

THIS IS A CRITICAL DISTINCTION
Your relationship with Chek Chek Digital Limited is that of an independent contractor, not an employee, agent, partner, or joint venturer. This Agreement does not create an employment relationship under the Ghana Labour Act, 2003 (Act 651) or any other applicable law.
2.1. No Employment Relationship
As an independent contractor, you: (a) are free to work for other platforms, companies, or clients simultaneously; (b) set your own hours and choose when to be available; (c) are not entitled to employment benefits, holiday pay, sick pay, pension contributions, or any statutory employment rights under the Labour Act; (d) are not subject to the Platform's disciplinary procedures applicable to employees; and (e) are responsible for your own tax affairs, National Insurance contributions (SSNIT), and compliance with all applicable tax laws.
2.2. Tax Obligations
You are solely responsible for declaring all income earned through the Platform to the Ghana Revenue Authority (GRA) and paying all applicable taxes, including income tax and any other levies. The Platform may, where required by law, report earnings to the GRA. You shall indemnify the Platform against any tax liability, penalties, or interest arising from your failure to comply with your tax obligations.
2.3. No Exclusivity
The Platform does not guarantee any minimum volume of delivery requests. You are free to accept or decline delivery requests at your discretion. However, consistently low acceptance rates may affect your ranking in the dispatch algorithm.

Part III — Road Safety, Conduct & Delivery Standards

3.1. Road Safety Obligations
You must at all times comply with the Road Traffic Act, 2004 (Act 683), the Road Traffic Regulations, 2012 (LI 2180), and all applicable traffic laws. This includes: (a) wearing a safety helmet at all times when operating a motorcycle; (b) obeying all traffic signals, signs, and road markings; (c) not operating under the influence of alcohol or controlled substances; (d) not using a handheld mobile device while driving; (e) observing speed limits; and (f) maintaining roadworthy vehicle condition. Traffic violations that result in Platform complaints may result in account suspension.
3.2. Customer Interaction Standards
You must maintain professional, courteous, and respectful conduct with all customers, vendors, and Platform staff. You must: (a) handle all food items with care to prevent damage, spillage, or contamination; (b) deliver all items to the correct address within estimated delivery times; (c) communicate promptly with customers regarding any delays; (d) not consume, tamper with, or open any food packages; and (e) not request tips or additional payments beyond the stated delivery fee.
3.3. Zero Tolerance Behaviours
The following constitute grounds for immediate permanent termination without notice:
●Operating without a valid driver's license or with expired insurance
●Involvement in a road accident while on an active delivery and failing to report it
●Harassment, threatening behaviour, or physical altercation with any customer or vendor
●Theft of goods, cash, or customer property
●Food tampering, contamination, or consumption
●Providing false documents or fraudulent information during registration
●Driving under the influence of alcohol or drugs
●Sharing account access with another person
3.4. Incident Reporting Obligation
You must report to the Platform within 2 hours any: (a) road traffic accident occurring during an active delivery; (b) customer complaint or confrontation; (c) theft or loss of delivered items; or (d) mechanical breakdown causing delivery failure. Failure to report incidents may constitute grounds for suspension pending investigation.
3.5. Performance Standards
You agree to maintain the following minimum performance standards: (a) customer satisfaction rating of not less than 3.8 out of 5.0; (b) on-time delivery rate of not less than 80%; and (c) completion rate for accepted orders of not less than 90%. Persistent failure to meet these standards will result in account review and may lead to deactivation.

Part IV — Liability, Indemnification & Insurance

4.1. Rider's Personal Liability
As an independent contractor, you bear sole and full personal liability for: (a) all road traffic accidents caused by your negligence, including damage to third-party vehicles, property, or persons; (b) personal injury to yourself arising from road accidents — the Platform does not provide personal accident insurance; (c) traffic fines, penalties, and court costs arising from violations of traffic laws; (d) claims by customers or third parties arising from your conduct or failure to deliver; and (e) any criminal liability arising from your actions while using the Platform.
4.2. Platform's Disclaimer of Liability
IMPORTANT: Nothing in this Agreement excludes liability that cannot lawfully be excluded under the Ghana Consumer Protection Act, 2023 (Act 1061), the Data Protection Act, 2012 (Act 843), or any other mandatory applicable Ghanaian law. Where any clause conflicts with a non-excludable statutory right or remedy, that right prevails to the extent of the conflict. Professional legal review of these liability provisions is currently being undertaken and this clause will be updated upon completion.

SUBJECT TO THE ABOVE, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM EXPRESSLY DISCLAIMS ALL LIABILITY FOR: (a) ANY ROAD TRAFFIC ACCIDENT, PERSONAL INJURY, OR DEATH INVOLVING THE RIDER; (b) DAMAGE TO THE RIDER'S VEHICLE OR PERSONAL PROPERTY; (c) THIRD-PARTY CLAIMS ARISING FROM THE RIDER'S DRIVING CONDUCT; (d) LOSS OF EARNINGS DUE TO VEHICLE BREAKDOWN, WEATHER, OR OTHER CIRCUMSTANCES; OR (e) CRIMINAL CHARGES OR REGULATORY PENALTIES IMPOSED ON THE RIDER. The Platform's role is solely to connect riders with food delivery opportunities through a technology platform.
4.3. Indemnification
You agree to fully indemnify, defend, and hold harmless the Platform, its directors, officers, employees, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, legal fees, fines, and regulatory penalties arising from: (a) your negligent or reckless operation of your vehicle; (b) your breach of any term of this Agreement; (c) your violation of any applicable road traffic, insurance, or other law; (d) any false or fraudulent information provided during registration; or (e) any third-party claim relating to your delivery operations.
4.4. Platform's Insurance — Scope & Limitations
The Platform does not hold or maintain: (a) motor insurance covering Rider vehicles; (b) personal accident insurance for Riders; (c) public liability insurance covering Rider-caused accidents; or (d) goods-in-transit insurance. Riders are solely responsible for obtaining adequate insurance coverage. The Platform strongly recommends comprehensive motor insurance with commercial / hire-and-reward cover.
4.5. Accident Protocol
In the event of a road traffic accident during an active delivery: (a) stop immediately and render reasonable assistance where safe; (b) call the Ghana Police Service (191) if there are injuries or significant property damage; (c) obtain third-party details (name, vehicle registration, insurance details); (d) photograph the scene; (e) notify the Platform within 2 hours via the app; and (f) do not admit liability at the scene. Failure to follow this protocol may affect your standing on the Platform.

Part V — Data Protection & Digital Security

5.1. Personal Data
By registering, you consent to the Platform collecting, storing, and processing your personal data including name, contact details, identification documents, GPS location data, and performance metrics, for the purposes of: (a) identity and document verification; (b) dispatch and delivery management; (c) performance monitoring; (d) compliance with legal obligations; and (e) communication regarding your account. Data is processed in accordance with the Data Protection Act, 2012 (Act 843).
5.2. GPS Location Tracking
You acknowledge and consent to GPS tracking of your location during active delivery sessions. Location data is used for: (a) efficient dispatch; (b) customer delivery tracking; (c) route optimisation; and (d) post-incident investigation where applicable. Location tracking ceases when you go offline on the Platform.
5.3. Customer Data
You will have access to customer delivery address and contact information solely for the purpose of completing assigned deliveries. You must not: (a) retain, record, or share customer personal data; (b) contact customers outside of the Platform for any purpose; or (c) use customer information for any personal or commercial advantage. Breach of this clause will result in immediate termination and may be reported to the Data Protection Commission.
5.4. Account Security
You are solely responsible for maintaining the security of your login credentials. You must not share account access with any other person. Each rider account is personal and non-transferable. The Platform implements two-factor authentication and you are required to enable it. Report any suspected unauthorized access immediately.

Part VI — Suspension, Deactivation & Dispute Resolution

6.1. Immediate Suspension Grounds
The Platform may immediately suspend your account, with or without prior notice, upon: (a) receipt of a credible incident or safety complaint; (b) discovery that your driver's license or vehicle insurance has expired; (c) evidence of fraudulent or falsified documents; (d) active police investigation involving you; (e) rating falling below 3.0; or (f) violation of any zero-tolerance behaviour listed in Clause 3.3.
6.2. Permanent Deactivation
Permanent deactivation will occur for: (a) confirmed serious misconduct (violence, theft, harassment); (b) criminal conviction for offences listed in Clause 1.6; (c) repeated document non-compliance; (d) operating without a license or insurance; or (e) material breach of this Agreement not remedied within 7 days of written notice. Deactivation is at the Platform's sole discretion and is final subject to the dispute resolution process.
6.3. Appeals Process
You may appeal a suspension or deactivation decision by submitting a written appeal within 14 days of notification. Appeals must include a clear explanation and supporting evidence. The Platform will review appeals within 10 business days and communicate its decision in writing. The Platform's decision on appeals is final.
6.4. Dispute Resolution
Any dispute arising from this Agreement shall first be referred to informal mediation. If unresolved within 21 days, disputes shall be submitted to arbitration under the Ghana Arbitration Centre rules, seated in Accra, Ghana. The language shall be English. This Agreement is governed by and construed in accordance with the laws of the Republic of Ghana.

Part VII — DaaS, Events & Emergency Features

7.1. Delivery-as-a-Service (DaaS) Deliveries
Where the Rider accepts Delivery-as-a-Service (DaaS) deliveries, the Rider acknowledges that: (a) DaaS deliveries are subject to the same independent contractor terms as food deliveries; (b) delivery fees are paid directly to the Rider's verified MoMo account — the Platform does not hold or pre-collect DaaS fees; (c) DaaS deliveries are tracked and recorded for settlement batch purposes; and (d) the Rider's DaaS delivery obligations are governed by the same road safety, conduct, and performance standards set out in Parts I–III.
7.2. Event Zone Deliveries
Where the Rider accepts event zone deliveries at a live event or festival venue, the Rider acknowledges that: (a) event deliveries occur at a temporary venue location and may involve crowd navigation; (b) the Rider is solely responsible for safety while navigating crowded event spaces; (c) event delivery fees are paid directly to the Rider's verified MoMo account; and (d) the Platform is not liable for any incidents arising from the event venue environment.
7.3. Emergency Alert & SOS Feature
The Platform provides an emergency alert (SOS) button during active deliveries. When the Rider or Customer triggers an emergency alert: (a) the Platform logs the alert with the Rider's last known GPS coordinates, order details, and both parties' contact information; (b) an SMS alert is sent to the Platform's on-call admin number; and (c) Ghana emergency contact numbers (Police: 112/191, Fire: 110, Ambulance: 117) are displayed to the user. The Rider acknowledges that the emergency alert feature is a supplementary safety tool and does not substitute for calling the Police Service (191) directly in an emergency. The Platform is not liable for any incident, injury, or loss arising from use or non-use of the emergency alert feature.
7.4. Cash Float Limits
Where the Rider accepts cash-on-delivery orders, the Rider may set a maximum cash float limit. The Platform uses this limit to avoid assigning cash orders that exceed the Rider's stated cash handling capacity. The Rider is solely responsible for cash security, counting, and reconciliation. The Platform is not liable for cash theft, loss, or discrepancy during delivery.
Acknowledgement & Digital Acceptance
By registering as a Rider on the Chek Chek platform and digitally accepting this Agreement during onboarding, you confirm that: (a) you are at least 18 years of age and legally authorised to work in Ghana; (b) you hold a valid DVLA driver's license of the appropriate class; (c) your vehicle is duly registered, roadworthy, and insured; (d) all documents and information submitted are genuine, accurate, and current; (e) you have read, understood, and agree to be bound by every term of this Agreement; and (f) you understand and accept that you operate as an independent contractor with no employment rights against the Platform.
